4. Exchange Evidence and Arguments
During the proceedings, both sides have an opportunity to present their legal arguments and supporting evidence. The court considers the relevant facts, documents, contractual provisions and applicable law before reaching its decision. The DIFC Courts operate in English, and court documents and hearings are conducted in English.
5. Judgment and Enforcement
Once the court reaches a final decision, enforcement may become the next important step, particularly where assets or parties are located outside the DIFC. The enforcement process can depend on where the relevant assets are located and the applicable procedures in that jurisdiction.
Commercial disputes can include different financial interests, contractual obligations and business relationships. A mistake at the jurisdiction or procedural stage can create additional costs and delays.
